Is it legal to keep a security dep.if nothing was signed?

I exchanged emails and verball discussed a move in date. I gave a cash deposit and backed out 1 day prior to move in date. I did not sign any agreement. He is not returning my $1950.00 deposit. Is this legal? Do I have any recourse ?
